These Terms of Service govern your use of www.sunriva.com.au and purchases from SUNRIVA. By using the website or placing an order, you agree to these terms. Nothing in these terms excludes rights that cannot lawfully be excluded, including rights under the Australian Consumer Law.

Online store

You must provide accurate, current and complete information when placing an order. You are responsible for keeping account credentials secure and for activity carried out through your account. You must not misuse the website, interfere with its operation, introduce malicious code or use it for unlawful purposes.

Products and product information

We take reasonable care to describe and photograph our products accurately. Because fruit is a natural product, colour, shape, size and texture may vary between batches and may differ slightly from photographs. Packaging may also change without notice. Please read the product label, ingredients, allergen information, storage directions and best-before information before consumption.

Orders

An order is an offer to purchase. We may accept or decline an order, including where a product is unavailable, information or pricing is incorrect, payment cannot be authorised or fraud is suspected. If we cancel an order after payment, we will refund the amount paid for the cancelled item. An order confirmation acknowledges receipt and does not necessarily mean the order has been dispatched.

Prices and payment

Prices are displayed in Australian dollars and include applicable GST unless stated otherwise. Delivery charges and any available shipping options are shown at checkout. Payment must be successfully authorised before an order is processed.

Shipping

Shipping destinations, costs and estimates are described in our Shipping Policy and shown at checkout where applicable. Please check your delivery details carefully. Delivery estimates are not guarantees, but we will provide clear information and assistance if we become aware of a material delay.

Returns, refunds and cancellations

Returns, refunds and cancellations are governed by our Return and Refund Policy. You may request cancellation within 24 hours, subject to whether processing or dispatch has begun. Your rights under the Australian Consumer Law continue to apply.

Food safety and allergens

Store products as directed on the label. Ingredients and allergen information are provided on product pages and packaging. If you have an allergy, intolerance, medical condition or dietary concern, review the label carefully and seek professional advice where appropriate before consuming the product.

Intellectual property

The website design, text, photographs, graphics, logos and other content are owned by or licensed to SUNRIVA and are protected by applicable intellectual-property laws. You may view and use the website for personal shopping purposes, but may not reproduce, distribute or commercially exploit its content without written permission.

Third-party services and links

The store may use or link to third-party services, including Shopify, payment providers and delivery providers. Their services may be governed by separate terms and privacy policies. We are not responsible for third-party websites that we do not control.

Liability

To the maximum extent permitted by law, SUNRIVA is not liable for indirect or consequential loss that was not reasonably foreseeable. This limitation does not apply where liability cannot be limited or excluded under the Australian Consumer Law or another applicable law.

Changes and availability

We may update the website, products and these terms from time to time. The terms that apply to an order are those available when the order is placed, except where a change is required by law.

Governing law

These terms are governed by the laws of New South Wales, Australia. Courts and tribunals with jurisdiction in New South Wales may hear disputes, subject to any rights you have to bring a claim elsewhere under applicable law.
